Postnuptial agreements are similar to prenuptial agreements and they accomplish many of the same goals as a prenuptial agreement, however, they are entered into between parties that are already married. Postnuptial agreements are most frequently entered into between parties when (1) one party has inherited or is about to inherit an asset or assets and (2) one person has a major career change. There are other reasons that individuals may seek to enter into a postnuptial agreement.

If the parties have minor children in common, the postnuptial agreement cannot provide for custody and visitation or child support.
