What Is Uncontested Divorce?

According to New York State law, an uncontested divorce occurs either when there are no disagreements between the parties and both spouses consent to the divorce, or when one party does not respond to the court action initiating the divorce.

Uncontested divorce is rather uncommon because of this lofty requirement: both spouses must agree on all major issues, such as property division, child custody, and spousal support, without disputes. Any disputed or contested issue would result in a contested divorce, and that means the need for a court hearing. 

Why Would Someone Choose Uncontested Divorce?

If you and your spouse mutually agree on the terms of your divorce, then an uncontested divorce offers a number of benefits over the standard divorce process. For starters, this type of divorce is often faster and less costly than a contested divorce, as it avoids prolonged court proceedings and the fees associated with them.
